CUSTOMER RELATIONSHIP OWNERSHIP & PORTABILITY POLICY
Effective Date: 5 June 2026
1. PURPOSE
BOOMieY is designed to help businesses, brands, creators, merchants, and organizations build, manage, and maintain direct relationships with their customers and communities.
This Policy defines:
- Ownership of Customer Relationship Data;
- Access rights to such data;
- Data portability and export rules;
- Platform limitations and safeguards; and
- The relationship between Sellers, Customers, and BOOMieY as a technology provider.
This Policy forms part of the broader BOOMieY legal framework, including the Privacy Policy, PDPA Notice, Customer Relationship Policy, Merchant Policy, and Seller Agreement.
2. DEFINITIONS
Seller means any business, merchant, creator, brand, organization, or entity operating on BOOMieY.
Customer Relationship Data means data generated through interactions between Sellers and Customers via the Platform, including but not limited to profiles, follows, memberships, purchases, subscriptions, messages, engagement history, and related interaction records.
Platform Data means data generated by BOOMieY systems, including infrastructure data, logs, analytics, security data, aggregated insights, and system-level information.
Exported Data means Customer Relationship Data that is made available for download or transfer to a Seller through Platform features.
3. OWNERSHIP OF CUSTOMER RELATIONSHIP DATA
Subject to applicable law and Customer rights:
- Sellers retain ownership of their Customer Relationship Data as it relates to their business interactions.
- BOOMieY does not claim ownership of Seller customer databases.
- Customer Relationship Data represents relationships formed between Customers and Sellers through the Platform.
- BOOMieY acts solely as a technology and infrastructure provider enabling such relationships.
Nothing in this Policy transfers ownership of Customer Relationship Data from Sellers to BOOMieY.
BOOMieY retains ownership of all Platform Data.
4. CUSTOMER RIGHTS
Customers retain all rights under applicable privacy and data protection laws, including:
- Access to personal data;
- Correction of inaccurate data;
- Deletion or restriction of processing (where applicable);
- Withdrawal of consent (where applicable);
- Other rights under applicable law.
Where conflicts arise between Seller practices and applicable law, legal requirements shall prevail.
5. PLATFORM DATA OWNERSHIP
BOOMieY retains exclusive ownership of all Platform Data, including:
- Software and system architecture;
- Infrastructure and technical systems;
- Algorithms and ranking systems;
- Security and fraud detection systems;
- Aggregated analytics and insights;
- Operational and performance metrics.
Sellers are granted no rights over Platform Data.
6. DATA ACCESS
Sellers may access Customer Relationship Data strictly for legitimate business purposes related to their relationship with Customers.
Access is subject to:
- Account status and compliance history;
- Platform functionality;
- Customer privacy requirements;
- Legal and regulatory obligations;
- Security and fraud prevention controls.
BOOMieY may restrict, limit, or revoke access where necessary to protect:
- Customer privacy;
- Platform integrity;
- Legal compliance;
- System security.
7. DATA PORTABILITY AND EXPORT
BOOMieY may provide eligible Sellers with the ability to export Customer Relationship Data.
Exported Data may include:
- Name;
- Email address;
- Phone number;
- Order history and relationship records (where permitted).
Export availability is subject to:
- Seller eligibility requirements;
- Compliance status;
- Minimum usage or transaction thresholds (if applicable);
- Legal and regulatory requirements;
- Customer consent requirements;
- Platform security and technical limitations.
BOOMieY reserves full discretion to approve, restrict, delay, or revoke export access at any time.
Exported data is provided solely for the purpose of continuing legitimate Customer–Seller relationships.
8. RESTRICTIONS ON EXPORTED DATA
Sellers agree that exported Customer Relationship Data shall NOT be used for:
- Unauthorized resale or data monetization;
- Unlawful marketing or spam activities;
- Data brokerage or third-party sharing without consent;
- Profiling outside the Seller’s legitimate business relationship;
- Any unlawful or non-compliant processing activities.
Sellers remain fully responsible for all use of exported data.
9. SELLER RESPONSIBILITIES
Sellers are responsible for:
- Complying with all applicable privacy and data protection laws;
- Obtaining required customer consents;
- Using Customer Relationship Data only for legitimate business purposes;
- Implementing appropriate security safeguards;
- Ensuring lawful handling of exported data;
- Preventing unauthorized access, misuse, or disclosure.
Exported data remains under the Seller’s sole responsibility once delivered.
10. PROHIBITED USES
Customer Relationship Data may not be used for:
- Illegal activities;
- Spam or unsolicited communications;
- Harassment or abuse;
- Fraud or deception;
- Misrepresentation of relationships;
- Violation of privacy laws or Platform policies.
BOOMieY may suspend or revoke access to data features for violations.
11. ACCOUNT TERMINATION
Upon termination or suspension of a Seller account:
BOOMieY may retain data where necessary for:
- Legal compliance;
- Fraud prevention;
- Security investigations;
- Dispute resolution;
- Regulatory obligations.
Where permitted, Sellers may request export of eligible Customer Relationship Data before termination becomes effective.
BOOMieY is not obligated to retain data indefinitely after termination.
12. LIMITATIONS
BOOMieY does not guarantee:
- Permanent availability of historical data;
- Completeness of all customer records;
- Unlimited storage or export history;
- Compatibility with external systems;
- Continuous or uninterrupted access to export features.
Operational, legal, and security limitations may apply.
13. PRIVACY LAW COMPLIANCE
All data processing, access, and export activities are subject to:
- Personal Data Protection Act 2010 (Malaysia);
- Applicable international privacy laws;
- BOOMieY Privacy Policy;
- BOOMieY Terms of Service;
- Applicable data processing agreements.
BOOMieY may refuse or restrict data export where required by law.
14. POLICY CHANGES
BOOMieY may update this Policy from time to time.
Updated versions become effective upon publication on the Platform.
Continued use of the Platform constitutes acceptance of the updated Policy.
