COPYRIGHT & INTELLECTUAL PROPERTY (DMCA-STYLE) POLICY
BOOMieY respects the intellectual property rights of others and expects all users of the Platform, including Creators and Sellers, to do the same.
This Policy provides a mechanism for reporting alleged intellectual property infringement and for responding to such claims.
1. REPORTING INTELLECTUAL PROPERTY INFRINGEMENT
If you believe that any content on BOOMieY infringes your copyright, trademark, or other intellectual property rights, you may submit a written notice to:
To be effective, your notice should include:
- Identification of the intellectual property that you claim is infringed;
- Identification of the material on BOOMieY that is allegedly infringing, including sufficient information to locate it;
- Your full name and contact information (email address and/or phone number);
- A statement that you have a good faith belief that the use of the material is not authorized by the rights owner, its agent, or the law;
- A statement that the information provided in the notice is accurate; and
- A statement, under penalty of perjury where applicable, that you are the rights owner or authorized to act on behalf of the rights owner;
- Your physical or electronic signature.
2. ACTIONS BY BOOMIEY
Upon receiving a valid infringement notice, BOOMieY may take one or more of the following actions at its discretion:
- Remove or disable access to the allegedly infringing content;
- Notify the user who uploaded the content;
- Request additional information or clarification;
- Temporarily restrict access to the content during investigation;
- Take further enforcement action, including suspension or termination of repeat infringers.
BOOMieY is not required to adjudicate intellectual property disputes and may rely on the information provided in notices submitted under this Policy.
3. COUNTER-NOTIFICATION
If you believe that content you submitted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification to BOOMieY at [LEGAL EMAIL], where permitted by applicable law.
A valid counter-notification should include:
- Identification of the content that was removed or disabled;
- A statement that you believe the content was removed in error or misidentification;
- Your contact information;
- A statement that you consent to the jurisdiction of the courts of Malaysia (or applicable jurisdiction);
- A statement that you will accept service of process from the original complainant; and
- Your physical or electronic signature.
BOOMieY may restore the content if legally appropriate.
4. REPEAT INFRINGER POLICY
BOOMieY may, in appropriate circumstances and at its discretion, suspend or terminate accounts of users who are determined to be repeat infringers.
5. FALSE CLAIMS
Submitting knowingly false or misleading infringement claims may result in:
- Account suspension or termination;
- Legal liability;
- Removal of access to BOOMieY services.
6. LIMITATION
BOOMieY acts as a neutral platform and does not make legal determinations regarding intellectual property ownership or infringement.
